Sec. 89-6-801. Purpose.

The purpose of this part is to regulate fencing requirements for all zoning districts including the location, height and type of fence required. (Enacted by Ord. No. 03-40, 07-15-2003)

 

Sec. 89-6-804. Regulations for specific zoning districts.

(a) Single-family and multi-family residential districts.

(1) Residential fencing location and height restrictions. Notwithstanding the setback, yard and height requirements for structures otherwise Stated in this Title, walls and fences may be located on the property line, adjacent to the sidewalk, or in the yard between the building setback line and the property line or sidewalk. The maximum height above the natural grade for a fence, wall, hedge, berm or similar unroofed landscape feature is:

a. Four feet where such fence or other feature is:

i. Located within the required front yard or street setback.ii. Sight obscuring and located in an area that is within ten feet of a driveway and 20 feet of a street.

b. Six feet where such fence or other feature is:i. Located behind the required front yard or street setback of any dwelling.

ii. Located in the front yard of dwellings located on a major collector, a minor arterial or a major arterial street.

c. Eight feet where such fence or other feature is located along a side or rear lot line, adjacent to a major arterial street.

(b) Public facilities district.Fences or walls shall not exceed four feet in height in front yards and six feet in side and rear yards.

(c) Professional office, commercial and manufacturing districts.

(1) No wall, fence, or opaque hedge higher than 36 inches is allowed within a required front yard or street side yard.

(5) No wall, fence, or opaque hedge or screening material shall be maintained or constructed within ten feet of a right-of-way line. (Enacted by Ord. No. 03-40, 07-15-2003)

Sec. 89-6-105. Clear vision area.

3) Retaining walls. Where a retaining wall protects a cut below the natural grade, and is located on the line separating lots, such retaining wall may be topped by a fence hedge or wall of the same height that would otherwise be permitted at the location if no retaining wall existed.

Where a retaining wall contains a fill, the height of the retaining wall built to retain the fill shall be considered as contributing to the permissible height of a fence, solid wall, or hedge, providing that in any event a protective fence or wall or hedge not more than 30 inches in height when of solid construction or such density as to not permit a clear unobstructed view of adjoining streets and sidewalks not exceeding 48 inches in height may be erected at the top of the retaining wall.

(b) Corner lots. Clear vision areas at intersections shall be provided according to standards contained in the City’s Public Improvement Standards, Specifications, and Plans manual. (Enacted by Ord. No. 03-40, 07-15-2003)

Sec. 89-6-110. Height limitation exceptions.

(a) Method of measurement. Where doubt exists as to height of fences, hedges, buildings, structures, etc., provided for in this Title, height shall be measured from the average finished grade of the front yard for buildings, or from the average finished grade of the yard in which fences, hedges or other such structures are located.
