17.06.030 Fence and clear view regulations.

A. The following provisions shall govern the height and location of fences, walls, plant growth, or other obstructions to view or access:
1. No fence, hedge or wall may exceed the height as further regulated herein or six feet, whichever applies.
2. Fences in front yards (in front of the front setback line of the respective zone) shall not exceed four feet in height. Clear view requirements must be met in all cases. Fences in corner side yards shall not exceed six feet in height and clear view requirements must be met in all cases.
3. No fences shall be allowed in the front yards of properties used for commercial or industrial purposes except as required for screening adjacent residential property or as approved as part of wwwelopment approval.
4. Fences up to eight feet in height may be allowed in the side (but not corner side) or rear yard provided a building permit is obtained from the city.

6. No fence, whether of wood, metal, masonry or concrete, nor other obstruction including shrubbery nor any combination of materials, shall be erected or maintained which blocks the access from a front yard through both sides to the rear yard unless a gate approved by the community wwwelopment department is installed in at least one side.
7. Construction of fences and retaining walls must meet applicable requirements of the building codes and be built to good engineering standards. For construction of all fences over six feet and retaining walls, a building permit must be secured and approvals obtained as described herein.
9. All fences and retaining walls must be maintained in a state of good repair.
10. Fences may be allowed to extend to the back of sidewalks, wherever a fence is permitted.
11. Clear View Requirements:
a. On corner lots, no obstruction to view will be permitted on that portion of the lot defined as the clear view area. Where curbs are installed, the clear view area shall include that portion of the corner lot lying within a triangular area formed by a diagonal line connecting lines located at the curb line thirty (30) feet from the projected intersection of such curb lines. Where no curb exists, the clear view area shall include that portion of the corner lot lying within a triangular area formed by a diagonal line connecting lines located at the property line twenty (20) feet from the intersection of said property line, or where property lines of adjacent properties extend into the right-of-way, the calculations shall be made from the edge of the improved right-of-way for a distance of thirty (30) feet and as otherwise described herein. Except, that this section shall not prohibit the following within the triangular area subject to approval of the community wwwelopment department:
(3) Non-view-obstructing fences not exceeding four feet in height.
b. No view-obstructing fence, wall, hedge or planting exceeding two and one-half feet in height above the level of the sidewalk shall be located in the triangular area bounded by lines drawn from a point on the centerline of any driveway, set back fifteen (15) feet from the front property line to points on the property line at the street in front of the property ten feet either side of both edges of the driveway; except that shade trees may be located or maintained in such area in excess of the height provided the same are clear of all branches between the ground and a height of six feet (if any tree trunk becomes an obstruction to sight, as determined by the community wwwelopment department, it must be removed). Non-view-obstructing fences not exceeding four feet in height may also be allowed in this area.
12. Retaining Walls. Where a retaining wall protects a cut below or a fill above the natural grade and is located on the line separating lots, such retaining wall may be topped by a fence, wall or hedge of the same height that would otherwise be permitted at the located as measured from the higher side ground level.

17. Exceptions:
a. The height and location requirements of this section shall not apply to fences required by state law to surround or enclose public utility installations, public schools or other public buildings.
b. Certain specialty fences requiring greater heights such as tennis courts, basketball backstops or patio enclosures in the side or rear yards, may be approved by the community wwwelopment department, if in the department’s opinion they do not create a hazard, nuisance or violation of other ordinances, and the applicant has submitted the signed approval of all property owners whose property abuts the applicant’s property.
c. In the required front yard of residential zones there may be permitted one open courtyard erected to a maximum height of six feet in accordance with the following standards:
1. No part of the structure shall be closer than ten feet to the front property line.
2. The courtyard shall be open and constructed of decorative ornamental wrought iron, mason, or wood.
3. The courtyard shall not extend into any side yard.
4. No courtyard structures shall obstruct vision or otherwise cause a safety hazard by blocking the view of vehicles or pedestrians using streets, drives, or walkways.
5. Before a permit is issued for a courtyard, a plan shall be submitted showing that the proposed courtyard complies with regulations and does not cause a safety hazard. The community wwwelopment department may issue or deny permits for good reason.

d. The community wwwelopment department may approve a chain link or decorative fence up to six feet high in front yards and up to ten feet high in side or rear yards upon public school property, or private schools which have curriculums similar to public schools and are approved by the state agencies approving school curriculums, when said school property is being utilized for school playgrounds or school-related recreational purposes, provided that any fence adjacent to any driveways or walkways or similar opening onto any street be installed to provide a minimum clear view as described in this chapter. At intersections of streets the fence shall comply with clear view requirements. The department may consider other factors prior to giving approval of the fence, including safety factors at areas where the school property adjoins other properties, aesthetics and any general safety factor. Approval must be obtained prior to installation of any fence under this subsection.

e. Security and safety fences of the appropriate height and in appropriate locations may be allowed in all zones for construction projects or for hazardous properties or buildings by the community wwwelopment department. Such fences shall be removed upon completion of the project or when deemed appropriate by the department.
f. The location and height of fences may be specifically approved by the city as part of a wwwelopment plan, even if those locations and heights do not conform to the standards herein, provided such approval was done as part of a public hearing process, is for a clear and specific purpose, and the intent of these standards are met.
