AMERICAN FORK CITY FENCE ORDINANCE
2.5.15 Fences, Walls and Hedges

1. General Requirements:

No fence, wall, hedge or similar wwwice extending into or enclosing all or any part of the front yard or any side yard adjacent to a street shall be constructed or maintained at a height greater than forty-two (42) inches; provided that where the fence fabric is to be of the chain link or other open mesh type and the fence will remain non-sight obstructing, the maximum height may be increased to not greater than forty-eight (48) inches. The maximum height of any fence, hedge, wall or similar enclosing wwwice situated within any other portion of a lot shall be six (6) feet.
All fences and walls shall be constructed of substantial material and design and construction shall be consist with the quality of dwellings and other improvements within the surrounding area. It shall be unlawful for any person to erect or cause to be erected or to maintain any barbed wire fence along or adjacent to any public street within the city.
Before commencing construction, plans for all fences and walls shall first be submitted to and approved by the Zoning Administrator.
Where, in the opinion of the Administrator, a proposed fence or wall does not conform to the above criteria, he shall refer the application to the Planning Commission for action. Any applicant aggrieved by a decision may appeal said decision to the Planning Commission who shall have the authority to reverse, affirm, or modify any decision of the Administrator.

2. Exceptions to Height Requirement

Fences, walls and similar structures exceeding six (6) feet in height may be permitted under the following circumstances and conditions.

1. Required by Other Government Regulation Where the additional height is required by law or other governmental regulation, subject to the receipt of a building permit.

2. Required for Increased Safety and Security Where additional height is needed to provide more adequate security for one of the following:

1. Utility facility compound area (i.e., gas regulating stations, electric substations, well site, etc.), subject to receipt of a building permit.
2. Swimming pools and open water impoundment areas, subject to receipt of a building permit.
3. Vehicle impoundment yards, self service storage facilities (mini-warehouses) and materials and equipment storage compounds (limited to commercial and industrial zones), subject to the prior approval of a site plan by the Planning Commission in accordance with the provisions of Section 2-5.32.
3. Double -frontage Lots

On lots which qualify as double-frontage lots, a fence, wall, hedge or similar enclosing structure (“fence”) may be placed not closer than 3 feet to the rear property line adjacent to a street, provided:

1. That the fence shall not exceed six (6) feet in height, and

2. The placement of the fence shall have been approved by the Planning Commission is accordance with the provisions of Section 2-5.32 subject to a finding that placement of the fence will not result in the establishment of a hazardous or unsafe condition.
